Terms of Service & Agreement

IMPORTANT: Strict No-Refund Policy Notice
Due to the custom software engineering, UI/UX design, cloud infrastructure, and digital marketing nature of our services, ALL ADVANCE DEPOSITS, MILESTONE PAYMENTS, RETAINER FEES, AND SUBSCRIPTIONS PAID TO TECHIFYTECH ARE 100% STRICTLY NON-REFUNDABLE once project scoping, design, or engineering work has commenced. Please review Section 3 below prior to initiating any project payment.
1. Acceptance of Terms & Scope
By engaging TechifyTech ("Company", "we", "us", or "our") for web development, mobile app development, Shopify development, digital marketing, or AI engineering services, you ("Client", "you", or "your") agree to be bound by these Terms of Service. Individual project deliverables and schedules are specified in your custom project proposal or Statement of Work (SOW).
2. Custom Engineering & Deliverables
TechifyTech provides high-performance custom digital solutions. Project milestones are executed in agreed stages:
- Milestone 1 (Deposit & Architecture): Scoping, wireframes, and database setup.
- Milestone 2 (Demo Build Review): Bi-weekly functional software demos for client feedback.
- Milestone 3 (Launch & Deployment): Production server deployment, SSL, and handover.
3. Payment Terms & Strict No-Refund Policy
All prices and milestone amounts are quoted in Indian Rupees (INR) or US Dollars (USD) as documented in the proposal.
3.1 Non-Refundable Payments: All milestone payments, upfront deposits, and retainer fees are non-refundable under any circumstances once work has commenced.
3.2 Resource Allocation: Because engineering time, server costs, and developer bandwidth are allocated exclusively to your project upon deposit, partial refunds or chargebacks are strictly prohibited.
3.3 Scope Changes: Any request for features outside the original Statement of Work will be quoted as a separate addendum and must be paid before implementation.
4. Intellectual Property & Code Ownership
Upon 100% full payment of all agreed invoice milestones, the Client receives complete ownership of the custom codebase, repository files, design assets, and database schemas developed specifically for the project. TechifyTech retains the right to showcase non-confidential project case studies in our portfolio.
5. Confidentiality & NDA
Both parties agree to protect proprietary business information, source code, data schemas, and trade secrets with strict confidentiality. A mutual Non-Disclosure Agreement (NDA) is executed prior to code reviews upon request.
6. Limitation of Liability & SLA Warranty
TechifyTech provides a 30-day post-launch warranty period to fix any software bugs related to the agreed scope. TechifyTech shall not be liable for indirect damages, third-party API outages (e.g. OpenAI, AWS, Google, Shopify), or server downtime outside our direct control.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with standard corporate laws of India. Any legal proceedings or arbitration shall be subject to competent court jurisdiction in India.
